California · November 3, 2026 · Legislative Constitutional Amendment

Proposition 5: Changes Recall Election Process for Statewide Officers.

Eliminates the simultaneous election of a successor when a state officer is recalled, leaving the office vacant until it is filled according to the constitution and state law.

The official ballot language

CHANGES RECALL ELECTION PROCESS FOR STATEWIDE OFFICERS. LEGISLATIVE CONSTITUTIONAL AMENDMENT. Under current law, voters elect replacement candidates at the same time as the recall election. This measure instead fills recall vacancies by subsequent special election or appointment.

• Under current law, voters decide at the same election whether (1) to recall a state officer, and (2) who will replace that officer if recalled. • Under this measure: if the Governor is recalled, the Lieutenant Governor becomes Governor for the remainder of the term or until a successor is elected; for all other recalled officers, the office will remain vacant until filled by a subsequent special election or appointment as specified in existing law; and a recalled officer may be a candidate in a special election to fill the office. Summary of Legislative Analyst's Estimate of Net State and Local Government Fiscal Impact: • Net fiscal effect unknown. Possible state and local government savings or costs of millions of dollars to administer recall elections. These costs or savings would be rare, and depend on the office recalled and how often recalls occur.

What your vote does

A YES vote

A "yes" vote supports eliminating the simultaneous election of a successor when a state officer is recalled (office stays vacant until filled per state law), allowing the recalled officer to run again at a special election, and having the lieutenant governor fill a gubernatorial vacancy until the term expires (with a special election in limited cases).

A NO vote

A "no" vote opposes this amendment, thereby maintaining the requirement that a simultaneous election to fill the statewide office vacancy be held at the time of the recall election.

What's actually in it — provision by provision

Propositions bundle things together. Here is every operative provision, separately:

  1. Eliminates the simultaneous election of a successor when a state officer is recalled; the office is left vacant and filled according to existing law.

Basis: Ballotpedia: ends the two-question recall ballot (recall + successor candidate); on a successful recall, the office is vacant and filled per existing law.

  2. If the governor is recalled, the lieutenant governor serves the remainder of the term; a special election may be held to fill the remainder.

Basis: Ballotpedia: lieutenant governor becomes governor for the remainder of the term on a recalled governor's removal.

Arguments, both sides

In favor

“SCA 1 will ensure that statewide and legislative recalls in California are democratic, fair, and not subject to political gamesmanship.”

— State Sen. Josh Newman (D-29) and Assemblymember Isaac Bryan (D-55), sponsors, via Ballotpedia [source]
Against

“The proposal of SCA 1 that the Lieutenant Governor simply assume the governorship in the event of a successful recall would make a gubernatorial recall effort a 'frying pan vs the fire' situation.”
